Abstract:

In the legal literature, the structures called as independent administrative authorities, the first examples of which are seen in the United States, but which became widespread in Continental Europe and accepted as new and original in public administration especially in the 70s and 80s as a result of privatization and economic policies in continental Europe have entered Turkish legal system as regulatory and supervisory bodies. It is often mentioned that these structures possess regulatory function in areas that are considered as sensitive areas of public life such as energy, capital, finance and money markets and are equipped with the competencies such as regulation, supervision and sanctioning with regards to markets. It has been claimed that these institutions have more unique and broader regulatory authorities than other administrative authorities in line with the regulatory function. The aim of this study is to determine the correctness or falsity of this claim by examining the source of these institutions' regulatory authorities.
