ABSTRACT

Convention on Limitation of Liability for Maritime Claims, 1976 is an international instrument providing rules for limitation of liability against maritime claims. The right of limitation of liability is usually invoked by the establishment of a limitation fund and types of limitation of liabilities are set out in this Convention. Turkey is a party to this Convention. Thus, Turkish Commercial Code (numbered 6102) contains complementary provisions regarding the limitation fund including the interest and expenses. Singapore is also a party to this Convention and Singapore High Court’s 14.04.2020dated As Fortuna Opco BV and another v Sea Consortium Pte Ltd and Others decision is significant for all the parties to the Convention due to the analysis on interest and expenses issues.
