Abstract:Digital evidences have their own characteristics, and are different from evidences known as classical. Due to this difference, they are not solely a subject of law, but also a subject of information technologies. A special process sequence is used in a composite field named computer forensics in the obtainment of digital evidences. Naturally, the different nature of digital evidences are reflected both in legal regulations and the court decisions representing the application of the regulations. As in all the fields of life, digital era also takes place in criminal procedure. The most important reason of this is the development and popularity of digital technology used in electronic devices. In a world in which digitalization is so common, the proofs that will lead to material fact also get their share of these developments. Yet more, some evidences named as classical also become digitalized. Therefore, the usage of digital evidences comprising of digital data increases day by day. This points to a huge change. The purpose of current study is to reflect this change in criminal law regarding proof in all aspects, and provide solution suggestions to eliminate the deficiencies in this field, which may be regarded as new.
